1. Acceptance of Terms

 

1.1. By accessing or using the services provided by Tennis Tots Ltd, you agree to comply with and be bound by these Terms and Conditions.

 

1.2. If you do not agree with any part of these Terms and Conditions, you must not use our services.

 

2. Subscription Services

 

2.1. Tennis Tots Ltd. offers children in-person tennis coaching subscriptions.

 

2.2. Subscribers must be parents or legal guardians of the child participating in the coaching program or have permission from the parent or legal guardian.

 

2.3. Subscription fees are outlined on the website www.tennis-tots.com and are subject to change with prior notice.

 

2.4 Subscribers will be billed on a four-weekly period, which gives access to one 45-minute session at one of our venues. If the participant cannot make a session, Tennis Tots Ltd will not issue a refund.

 

2.5 On sign up, you will be given one free tennis Tots T-shirt. If this is lost, the parent will need to buy a replacement. We will offer a T-shirt recycling service when children grow out of their tops; however, there will be limited availability.

 

3. Registration and Account Security

 

3.1. Subscribers must provide accurate, current, and complete information during the registration process.

 

3.2. Subscribers are responsible for maintaining the confidentiality of their account information, including login credentials.

 

3.3. Tennis Tots Ltd. reserves the right to suspend or terminate accounts if any information provided is found to be inaccurate, incomplete, or violates these Terms and Conditions.

 

4. Trial Period

4.1 Tennis Tots Ltd. offer two free trial sessions. These must be booked online before the session.

 

4.2  We recommend that the two trial sessions are taken back to back; however, they can be taken over a six-week period. After the two trial sessions or one trial session and a six-week expiration period, any further participation will be prohibited until subscription.

 

4.3 After a six-month period of not attending Tennis Tots, returning participants are granted one more free trial session. This must be booked online.

 

5. Siblings, friends and relatives

5.1 Siblings are encouraged to sign up together, and we have a discounted rate for siblings (please see details on the website). If they are coming on a one-off basis, please use the website to sign up for a trial session. If friends or siblings are not participating in the session, they are welcome to sit in the hall without signing up and watch the session. Please note that Tennis Tots Ltd. accept no responsibility for their safety.

 

5.2 Any siblings, friends or relatives in the hall must comply with our code of conduct. Tennis Tots Ltd. reserves the right to ask them to leave if this is not the case. 

 

6. Payment and Billing

 

6.1. Payment for subscriptions is processed through secure third-party payment gateways.

 

6.2. Subscribers are responsible for providing accurate billing information and ensuring timely payments.

 

6.3. Failure to make timely payments may result in the suspension or termination of subscription services.

 

7. Cancellation and Refund Policy

 

7.1. Subscribers may cancel their subscriptions at any time through their account settings on the website.

 

7.2. Tennis Tots Ltd. does not provide refunds for partial subscription periods

 

7.3 Payments will be taken on a four-week period, depending on your start-up date. Once a payment has been made, Tennis Tots Ltd. will not issue any refund for the four-week period if a subscription is cancelled.

 

7.4 If Tennis Tots Ltd. offers an advanced booking subscription deal, no refunds will be made if the participant wishes to stop attending sessions before the calendar end of this offer.

 

7.5 If live classes are cancelled for any reason outside the control of Tennis Tots Ltd, including (without limitation) as a result of an “Act of God” (e.g. disruption resulting from extreme weather conditions, earthquakes, strikes or terrorist activity), or where local or governmental authorities/public guidance advise that live classes should be temporarily suspended for health or other reasons (‘Extreme Reasons’), then no refunds nor credits shall be given. Tennis Tots Ltd reserves the right to provide online classes as a replacement for, or alternative to, live classes where it is not possible or reasonably practicable to offer live classes, including (without limitation) for the aforementioned Extreme Reasons. In doing so, Tennis Tots Ltd shall satisfy its contractual obligations hereunder, and there shall be no entitlement to any refund or credit.

 

7.5 In the unlikely event of ‘last minute’ lesson changes or a lesson cancellation by us, Tennis Tots Ltd. will notify you with as much notice as possible. Tennis Tots Ltd. will not reimburse any expenses incurred by customers failing to pick up their message.

 

7.6 If insufficient children are booked into your class, we reserve the right to cancel the class. In this instance, we will offer you either an alternative class or an online class to attend, or a refund will be given for any remaining sessions after the cancellation.

 

8. Content Usage and Restrictions

 

8.1. Subscribers are granted a limited, non-exclusive, non-transferable license to access and use the coaching programme for personal, non-commercial purposes.

 

8.2. Reproduction, distribution, or public display of coaching content is strictly prohibited without prior written consent from Tennis Tots Ltd.

 

8.3  Tennis Tots Ltd. is a trademarked brand and cannot be used without permission from Tennis Tots Ltd.

 

8.4  All games and training exercises have been designed by Tennis Tots Ltd. and cannot be copied without the express permission of Tennis Tots Ltd.

 

8.5 By agreeing to these Terms & Conditions, any participant will not share any aspects of the Tennis Tots programme with a third party who may be involved in a business that operates in the same market as Tennis Tots or is indirectly concerned with such a company. In addition, any of Tennis Tots’s material will not be replicated directly or indirectly for their own use or use by any third party.

 

9. Code of Conduct

 

9.1. Subscribers and participating children must adhere to a code of conduct promoting a positive and respectful learning environment, as well as being friendly and cooperative to coaches and other participants.

 

9.2. Any violation of the code of conduct may result in the suspension or termination of subscription services.

 

9.3 Tennis Tots Ltd. has zero tolerance for abusive behaviour from parents or children. This includes verbal abuse or physical abuse to other people, the venue and equipment. Tennis Tots Ltd. reserves the right to prohibit persons from attending sessions and cancelling subscriptions at any time.

 

9.4 All equipment provided by Tennis Tots Ltd. is owned by the company and must remain on site. Any equipment removed from site without permission from Tennis Tots Ltd. will be treated as theft.

 

10. Limitation of Liability

 

10.1. Tennis Tots Ltd. is not liable for any injuries, damages, or losses incurred during or as a result of participating in the coaching program.

 

10.2. Tennis Tots Ltd. is not responsible for any technical issues, interruptions, or failures that may affect the availability of subscription services.

 

10.3 Tennis Tots Ltd. is not liable for any loss of participants’ property before, during or after Tennis Tots sessions

 

10.4 The participant agrees that any claim made against Tennis Tots Ltd. will be made in writing within 30 days of the incident, and failure to report in writing within this time will negate any such claim.

 

10.5 The maximum aggregate liability for Tennis Tots Ltd. to the Participant, Parent and Carer will not exceed the Fees.

 

10.6 Neither Tennis Tots Ltd. nor any coach, coaches assistant, any employee, agent or other representative accepts responsibility in respect of loss, damage or expense incurred by a Participant, Parent and Carer arising directly or indirectly or in any way connected with the attendance of the Participant, Parent and Carer at Classes (or any Class) or any other act or omission on the part of Tennis Tots Ltd. its coaches, coaches assistants, employees, agents and/or representatives.

 

10.7 All warranties and conditions, whether implied by statute or otherwise, are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of Tennis Tots Ltd. It’s coaches, assistants, employees, agents and/or representatives or affects the parent’s or participant’s statutory rights.

 

10.8 The Parent and/or Carer agrees that any product purchased from the Tennis Tots Ltd. merchandise store is to be used at their own risk. Tennis Tots Ltd. will not accept responsibility for any personal injury which may occur due to improper use. As a consequence, Tennis Tots Ltd. recommends that all equipment be used under the supervision of a Parent/Carer.

 

11. Privacy Policy

 

11.1. Tennis Tots’ privacy policy on the website outlines how personal information is collected, used, and protected.

 

12. Consent

12.1 By partaking in Tennis Tots, you agree that from time to time, it may be appropriate for a coach to assist your child using physical contact. This may be guiding them to perform the correct technique or supporting them. It is the parent’s responsibility to be with their child at all times, and should never be left alone in the session. All the coaches have been trained in safeguarding and have undergone DBS checks.

 

12.2 By partaking in Tennis Tots, you agree that photos and videos will be taken for marketing and training purposes. If you do not want your child to be featured in any published videos, please email us at admin@tennis-tots.com, and we will not use any images that include your child.

 

13. Safeguarding

 

13.1 Parents must stay with their child at all times; if either parent or child leaves the room, they must go together. Parents are 100% responsible for their child’s safety with no liability on Tennis Tots Ltd.

 

13.2 Parents must not physically touch other children without parental permission.

 

13.3 Filming and photographing are encouraged during the session; however, please film only your child. Any publicly posted videos or images must only contain your child unless you have parental consent.

 

14 Medical

 

14.1 It is the Parent and Carer’s responsibility to inform Tennis Tots of any special medical conditions at the point of booking—this includes behavioural disorders.

 

14.2 The Participant and/or Parent and/or Carer must not attend any Class whilst suffering from serious illness, contagious disease, or anything similar.

 

14.3 Parents/Carers should provide water, but no food must be eaten during the session to prevent choking hazards.

 

14.4 Please ensure your child wears athletic clothing and proper footwear for each session. Ensure you have packed appropriate clothing for all weather conditions for those sessions running outdoors (We will notify you if a session occurs outdoors).

 

15. Changes to Terms and Conditions

 

15.1.Tennis Tots Ltd. reserves the right to modify these Terms and Conditions at any time. Subscribers will be notified of any changes, and continued use of the services constitutes acceptance of the revised terms.

 

16. Governing Law

 

16.1. These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom.

 

16.2 By using our services, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.

 

16.3 Any notices sent by either party to the other shall be transmitted by pre-paid recorded delivery or hand-delivered to the relevant party’s address and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand-delivered.

 

16.4 The failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or the right at any time subsequently to enforce any or all of such obligations.

 

16.5 These terms and conditions constitute the entire agreement between the parties hereto and supersede prior agreements and understandings between the parties
